The Verge published a sharp analysis on June 17 capturing a legal reality that experts have been quietly flagging all week: the government’s legal basis for this action is genuinely murky. The Export Control Reform Act of 2018 was designed for physical goods — chips, hardware, and weapons components. Applying it to a cloud-accessed AI model is legally novel because, as The Verge notes, there’s no actual “transfer” happening: “Mythos and Fable continue to be on Anthropic’s servers, and users do not receive the code, weights, or a copy of the models — they only receive responses from the chatbot”.

That distinction matters enormously in export control law, and no court has ruled on it yet.

The Pentagon Supply Chain Paperwork Is Now Official

Separately, the Pentagon has now formally delivered the official supply chain risk designation paperwork to Anthropic, the bureaucratic process that had been pending for months. This is distinct from the Commerce export controls, but it compounds Anthropic’s legal and operational headaches: it is now formally designated a national security risk by the Defense Department and subject to export controls from the Commerce Department, simultaneously.
